These Terms and Conditions ("Terms") govern your access to and use of PIWA, PiLearn, PiMeet, CCL, PiMarketing, and any other product or service (collectively, the "Services") made available by Python Analytics Pvt Ltd ("Python Analytics", "we", "us", or "our"), a company registered in India (DPIIT Registration No. DIPP139814), headquartered in Nagpur, Maharashtra. By accessing or using any of the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. Eligibility

You must be at least 18 years of age and legally capable of entering into a binding contract to use the Services. By using the Services, you represent and warrant that you meet these requirements and that all registration information you submit is accurate and complete.

2. Description of Services

PIWA is an AI-powered, omnichannel business growth platform enabling communication, marketing automation, AI chatbots, campaign management, and related capabilities across WhatsApp, SMS, Email, RCS, and other supported channels. PiLearn is a learning management platform, PiMeet is a virtual meeting/conferencing platform, CCL is a competition and evaluator platform, and PiMarketing/piAI Digital Services provides marketing and growth-related services. Features, availability, and pricing for each Service may change from time to time at our discretion.

3. Account Registration and Responsibilities

To use certain Services, you must create an account and provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security.

4. Subscription, Billing, and Payment

Certain Services are offered on a subscription basis (recurring billing) and others on a one-time payment basis, as described at the point of purchase. Payments are processed through third-party payment gateways, including Razorpay and/or Stripe. By making a payment, you agree to the applicable payment gateway's terms of service in addition to these Terms. We do not store your full card, UPI, or bank account credentials; these are handled directly by our payment processors in accordance with applicable data security standards (including PCI-DSS, where applicable).

You authorize us to charge your chosen payment method for all fees due in connection with your use of the Services, including recurring subscription fees, unless and until you cancel in accordance with these Terms.

5. Acceptable Use

You agree not to use the Services to: (a) send unsolicited, spam, or bulk messages in violation of applicable messaging platform policies (including WhatsApp's Business Policy and Meta's Platform Terms); (b) transmit content that is unlawful, defamatory, obscene, fraudulent, or infringing on third-party rights; (c) attempt to gain unauthorized access to our systems, other users' accounts, or any connected third-party platform; (d) reverse-engineer, decompile, or attempt to extract the source code of the Services, except as permitted by law; (e) use the Services in a manner that violates any applicable local, state, national, or international law or regulation.

We reserve the right to suspend or terminate access to the Services for any account found in violation of this section, with or without prior notice, at our sole discretion.

6. Third-Party Integrations and Dependencies

The Services integrate with and rely on third-party platforms, including but not limited to Meta/WhatsApp Business API, Razorpay, Stripe, and various communication carriers. Your use of these integrated features is also subject to the respective third party's terms of service and policies. We are not responsible for outages, policy changes, feature deprecations, or service interruptions caused by these third parties, and such events do not constitute a breach of these Terms by us.

7. Intellectual Property

All intellectual property rights in the Services, including but not limited to software, design, trademarks (including "PIWA," "PiAI," "PiLearn," "PiMeet," and associated logos), and content created by Python Analytics, are owned by Python Analytics Pvt Ltd or its licensors. Nothing in these Terms grants you any right to use our trademarks, logos, or brand features without our prior written consent. You retain ownership of content and data you upload or transmit through the Services, subject to the license you grant us to process such data in order to provide the Services.

8. Service Availability and Disclaimers

We aim to provide reliable and continuous access to the Services but do not guarantee uninterrupted, error-free, or 100% available operation. Scheduled maintenance, third-party outages (including WhatsApp/Meta platform disruptions), and factors outside our reasonable control may result in temporary unavailability. The Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, to the maximum extent permitted by applicable law.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Python Analytics Pvt Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities, arising out of or in connection with your use of, or inability to use, the Services, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim arising under these Terms shall not exceed the amount paid by you to us for the Service giving rise to the claim in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Python Analytics Pvt Ltd, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice, including for violation of these Terms. You may terminate your account at any time by following the cancellation process described in our Refund and Cancellation Policy. Upon termination, your right to use the Services ceases immediately; provisions of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) shall continue to apply.

12. Changes to These Terms

We may revise these Terms from time to time. Material changes will be notified through the Services or via email where applicable. Your continued use of the Services after any such change constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at Nagpur, Maharashtra, India.
